Results Management

Results management is the process encompassing the period between notification of a potential anti-doping rule violation (ADRV) and the final resolution of the matter. This includes any disciplinary hearings and appeals.

Anti-Doping Rule Violations (ADRVs)

The Prohibited List is only one part of the Anti-Doping rules. There are currently 11 types of violations under the World Anti-Doping Code. It is important to remember that doping is not just a positive test.

1. Presence

Presence of a Prohibited Substance, its metabolites, or markers in an athleteâ€™s sample. Under strict liability, athletes are responsible for what is found in their system, regardless of intent.

2. Use or Attempted Use

Use or attempted use of a Prohibited Substance or a Prohibited Method. The success or failure of the use does not matter; the act itself is a violation.

3. Evading, Refusing, or Failing to Submit

Evading sample collection, or refusing or failing to submit to sample collection without compelling justification after proper notification.

4. Whereabouts Failures

Any combination of three missed tests and/or filing failures within a 12-month period for an athlete in a Registered Testing Pool.

5. Tampering

Tampering, or attempting to tamper, with any part of the doping control process by an athlete or other person.

6. Possession

Possession of a Prohibited Substance or Method by an athlete or support person, unless justified by a valid Therapeutic Use Exemption (TUE).

7. Trafficking

Trafficking, or attempting to traffic, any Prohibited Substance or Prohibited Method by an athlete or other person.

8. Administration

Administering, or attempting to administer, a Prohibited Substance or Method to any athlete In-Competition or Out-of-Competition.

9. Complicity

Assisting, encouraging, aiding, conspiring, covering up, or any other intentional complicity involving an anti-doping rule violation.

10. Prohibited Association

Associating professionally or in a sport-related capacity with support personnel who are currently serving a doping ban or have a doping-related conviction.

11. Discouraging or Retaliating

Threatening, intimidating, or retaliating against someone who reports alleged anti-doping violations or non-compliance in good faith to authorities.

Process Timeline

1. Receipt of the Analytical Finding

The Egyptian Anti-Doping Organization (EGY-NADO) receives a report from a WADA-accredited laboratory indicating an Analytical Finding.

2. Initial Review

EGY-NADO reviews the result and the relevant documentation, including verifying whether a Therapeutic Use Exemption (TUE) exists, determining whether there is any apparent justification for the finding, and identifying whether any additional requirements need to be addressed before notifying the Athlete.

3. Notification letter

The Athlete is formally notified of the lab results, including the prohibited substance(s) or prohibited method involved and the rights and procedures available to them, including their right to request the analysis of the B Sample, in accordance with the applicable rules.

4. Notice of Charge

If, following the review and investigation, there are sufficient grounds, the Athlete is notified of the Anti-Doping Rule Violation (ADRV) and the relevant Article, and is given the specified period to respond or accept the proposed consequences.

5. Hearing

If there is no early admission of an Anti-Doping Rule Violation or agreement is not reached through the applicable procedure, the Athlete may refer the case to an independent Hearing Panel to consider the facts, evidence, and the Athlete’s submissions, and to determine whether an ADRV has been committed and the applicable consequences.

6. Decision & Appeal

A final decision is issued, and the parties entitled to appeal are notified, with the right to appeal to the Appeal Committee or the Court of Arbitration for Sport (CAS), as applicable under the relevant rules.

Transparency & Confidentiality

During the results management process, EGY-NADO maintains strict confidentiality.

Sanctions & Consequences

Violating anti-doping rules can have severe consequences for your career, health, and reputation. Sanctions for an ADRV can include:

Disqualification: Loss of results, medals, points, and prizes from a specific competition.
Ineligibility: A ban from participating in any sport for a period of time (ranging from a reprimand to a lifetime ban).
Public Disclosure: Publication of the athlete's name, violation, and sanction.
Financial Penalties: Fines or repayment of prize money.

The Legal Process

Athletes have the right to a fair hearing and the right to appeal any decision. EGY-NADO ensures that the results management process is independent and transparent.
